1. Agreement to these terms
These Terms of Service form a binding agreement between you and Turnip Games, LLC, a Wisconsin limited liability company that provides Tourn.app (“Turnip Games,” “Tourn.app,” “we,” “us,” or “our”). By accessing the service, creating or joining a trip, or purchasing a trip pass, you agree to these terms and the Privacy Policy. If you use the service for an organization or group, you represent that you may accept these terms for it.
2. Eligibility and accounts
You must be at least 13 years old and legally able to enter this agreement. If you are under the age of majority where you live, a parent or legal guardian must approve your use. Accounts rely on the identity information presented by the sign-in provider. You are responsible for protecting your account and for activity performed through it. Notify us promptly if you believe an account has been compromised.
3. Trip roles and organizer responsibility
Trip owners and trip administrators control invitations, membership, events, scoring, and content within their trip. Organizers must invite only people they are authorized to contact and must obtain any consent required to share a participant’s name, phone number, email address, likeness, or other personal information. A role applies only to the trip for which it was granted. Platform administrators may act across trips for security, support, fraud prevention, and service administration.
4. Trip tiers, retention, and payment
Tourn.app offers free and paid one-trip tiers with different durations, limits, included features, and content-retention periods. For the Free tier, tournament results and user-generated content remain available through the 30th day after the tournament ends. The trip owner may download the trip export during that period. Free-tier content may become unavailable or be deleted after the retention period, so owners should download anything they wish to keep. Current prices and tier details are shown before trip creation and checkout. Paid tiers are one-time purchases, not subscriptions. Payment processing is provided by Stripe and is subject to Stripe’s terms. Except where law requires otherwise, a paid trip is non-refundable after activation. If we cannot provide a paid trip because of our error, contact us for review of a replacement or refund.
5. Acceptable use
You may use Tourn.app only for lawful, private recreational tournaments and related group activities. You may not use the service to harass or threaten others, impersonate a person, send unsolicited invitations, infringe intellectual property or privacy rights, upload malicious code, bypass access controls, scrape the service, interfere with its operation, or create unlawful gambling, wagering, or prize schemes. You are responsible for verifying local rules that apply to any contest, prize, or activity you organize.
6. User content
You retain any ownership rights you have in content you create, submit, post, or upload, including event details, scores, comments, images, audio, video, logos, and other materials (“User Content”). You grant us a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, use, modify, adapt, create derivative works from, publish, display, perform, distribute, transmit, and otherwise process User Content as reasonably necessary to provide, operate, maintain, secure, support, develop, and improve Tourn.app and its service features. This license continues for as long as the User Content is stored by or used for the service and afterward to the extent reasonably necessary for backups, legal compliance, dispute resolution, and enforcement. You represent that you have all rights and permissions needed to submit the User Content and grant this license.
We may review, restrict, disable access to, remove, or permanently delete any image or other User Content, with or without prior notice, that we reasonably believe is illegal, abusive, harmful, fraudulent, infringing, violates another person’s rights, violates these terms, or creates legal, safety, security, or operational risk. We may also preserve and disclose content when reasonably necessary to comply with law, protect users or the service, or investigate suspected violations.
7. Invitations and communications
Organizers may ask us to deliver transactional email or SMS invitations. The organizer is responsible for the recipient information and authorization to send the invitation. Recipients can ignore an invitation and should report misuse. Carrier messaging and data rates may apply. We do not use trip invitation contacts for unrelated marketing.
8. Scores, activities, and safety
Tourn.app is an organizational tool. We do not verify scores, officiate events, supervise activities, or guarantee participant conduct. Organizers and participants are responsible for rules, equipment, locations, weather decisions, physical safety, alcohol use, transportation, and compliance with law. Do not rely on the service for emergency communications.
9. Third-party services
The service uses third parties for sign-in, hosting, storage, payment processing, email, SMS, and imagery. Their terms and privacy practices may apply when you interact with them. We are not responsible for third-party services that we do not control.
10. Availability and changes
We may update, suspend, or discontinue features and may perform maintenance without notice. We do not promise uninterrupted or error-free operation. We may change these terms by posting an updated version and effective date. Material changes will be communicated through the service when reasonably practicable. Continued use after a change takes effect constitutes acceptance.
11. Suspension and termination
You may stop using the service at any time. We may limit or terminate access if you violate these terms, create risk for users or the service, fail to pay, or if required by law. We may preserve records as required for security, disputes, legal obligations, and legitimate business purposes. Sections that by their nature should survive termination will survive.
12. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will meet every requirement, preserve every item of content, or produce error-free scores or standings. Some jurisdictions do not allow certain disclaimers, so these limitations may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, Turnip Games, LLC and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities. Our aggregate liability arising from the service will not exceed the greater of US $100 or the amount you paid us during the 12 months before the claim. This section does not limit liability that cannot lawfully be limited.
14. Indemnity
To the extent permitted by law, you will defend and indemnify Turnip Games, LLC from third-party claims, losses, and reasonable costs arising from your user content, your trip administration, your violation of these terms, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.
15. Governing law and disputes
Wisconsin law governs these terms without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes must be brought in the state or federal courts serving Dane County, Wisconsin, and each party consents to their jurisdiction. Before filing a claim, each party will make a good-faith effort for 30 days to resolve it informally.
16. General terms
These terms and the Privacy Policy are the entire agreement about the service. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign this agreement without our consent. We may assign it in connection with a reorganization, financing, merger, acquisition, or sale of assets.
